TERMS and CONDITIONS

GUIDED WALKS



1. References

1.1.  In the following conditions, Wiltshire Walks, and any subsidiaries or associated companies, shall be referred to as "the Company".

1.2.  The person(s) with whom the Company is dealing shall be referred to as "the Customer".

1.3.  The services, facilities, documentation or data supplied by the Company to the Customer shall be referred to as "the Services".


2. These conditions reflect that:

2.1.  Acceptance of the Company Services by the Customer implies acceptance of these Terms and Conditions.

2.2.  The Company may delegate to any sub-contractor or other organisation, performance of any part of its obligations to the Customer.

2.3.  The Company may vary these Terms & Conditions at any time.


3. Payment for services:

3.1.  The Customer shall pay a deposit of 25% or £20.00 (whichever is the greater) at the time of booking.

3.2.  The Customer shall pay, in full, all further monies due to the Company at least 30 days prior to the Company providing the Services.

3.3.  The Service will be deemed to be cancelled if full payment is not received at least 30 days before the Date of the Service, in which case the Company shall retain the Deposit paid, and return any Balance to the Customer.  (See also Section 6).

3.4.  The Company reserves the right to charge a fee to cover any expenses incurred through the return of payments from our Banks or from other organisations such as The Post Office.


4. Customer Health and Safety Responsibility:

4.1.  The Company shall consider that Customers will be fit and healthy on the dates of Guided Walks.

4.2.  The Company shall provide basic guidance on the difficulty of each Guided Walk.

4.3.  The Customer should seek medical guidance regarding their health and capability of partaking in any particular Guided Walk.

4.4.  The Customer should advise the Company of any medical condition, and provide evidence of capability if so asked by the Company.

4.5.  The Customer should take adequate insurance to cover risks associated with Guided Walks, should unforeseen cancellation be required, the loss or damage to any clothing or equipment, and for any liability that may arise.


5. Safety Responsibility during Guided Walks:

5.1 .  In the interest of safety, the Customer shall follow all directions and advice given by the Company personnel, or that of any official signage encountered during a Guided Walk, and that of The Countryside Code.

5.2.   The Customer shall not act in any manner which would endanger themselves or others, or cause a nuisance to others.

5.3.   The Customer should ensure that all clothing and walking equipment is of satisfactory quality for purpose, and which shall not endanger themselves or others.

5.4.  The Customer shall maintain control over any dog brought to a Guided Walk, and shall use an adequate lead for such control when instructed by any Company personnel or when official signage demands.

5.5.  Children under 18 must be accompanied by a parent or lawful guardian, and should supervise such young persons at all times.

5.6.  The Company personnel shall not deliberately place any person into any hazardous or dangerous situation.

5.7.  The Company cannot accept responsibility for any unknown hazard encountered during Guided Walks.

5.8.  The Company personnel cannot offer any medical advice or give any medical aid during Guided Walks.

5.9.  Save for any proven negligence, the Company cannot accept any liability for any accident, damage or loss.


6. Cancellation of Guided Walks

6.1.  The Company reserves the right to cancel any Guided Walk at any time, in which case the Customer shall be offered another Guided Walk of equal value, or offered a full refund.

6.2.  The Company reserves the right to modify any Guided Walk in the event of any unforeseen circumstance making this necessary.

6.3.  Should the Customer cancel any pre-booked Walk, then the Customer should supply written notice of such, and the Company will retain the following value of payment depending upon the notice given:

· More than 30 days - the Deposit

· 14 to 30 days 50%

· 0 to 13 days 100%

6.4.  Should the Customer fail to pay in full, then the Service will be deemed to have been cancelled by the Company, who shall retain the Deposit paid by the Customer, and return any Balance to the Customer.

6.5.  In the event of a ‘non-show’ or late arrival (more than 30 minutes) for a Guided Walk, the Company shall retain 100% of payment.


7. Miscellaneous

7.1.   The Company shall accept no responsibility for the accuracy of any verbal or documented information, supplied either before,  during or after any Service performed by the Company.

7.2   The Company shall accept no responsibility for the accuracy of any GIS data (Geographical Information such as Maps or Location Fix data) supplied either before,  during or after any Service performed by the Company.


8. English Law

8.1.  These conditions shall be governed by, and construed in accordance with English Law, and the Courts of England and Wales shall have exclusive jurisdiction to determine any disputes arising between the Company and the Customer.

8.2.  These Terms do not affect the Statutory Rights of the Customer.

GOODS and SERVICES




1. References

1.1. In the following conditions, Wiltshire Walks, and any subsidiaries or associated companies, shall be referred to as "the Company".

1.2. The person(s) with whom the Company is dealing shall be referred to as "the Customer".

1.3. The goods, services, facilities, documentation or data supplied by the Company to the Customer shall be referred to as "the Services".


2. These conditions reflect that:

2.1. Acceptance of the Company Services by the Customer implies acceptance of these Terms and Conditions.

2.2. These conditions may contain clauses excluding and modifying the liability of the Company.

2.3. The Company may delegate to any sub-contractor or other organisation, performance of any part of its obligations to the Customer.

2.4. The Company may vary these Terms & Conditions at any time.


3. Payment for services:

3.1. The Customer shall pay, in full, all monies due to the Company prior to the Company providing the Services.

3.2. Customers may apply for Credit Terms, in which case the Customer shall pay, in full, all monies due on each Invoice within 30 days of the  Invoice Date. This time shall be known as the “Credit Time".  The Company shall issue such Invoices before or after completion of the Service, or  after such agreement between the Company and the Customer.

3.3. Any moneys due to the Company after the Credit Time will accrue daily interest from the date due, until the date of payment.  The interest rate shall be set at 5% above the Bank of England base rate in force during the period of time that the moneys are due.  The Customer shall be liable to pay this interest at the said rate, together with any costs incurred by the Company in recovery of payment.

3.4. The Company reserves the right to charge a fee, to cover any expenses incurred through the return of payments from our Banks.

3.5. The Company reserves the right to vary its charges at any time without giving notice to the Customer.

3.6. Minimum Order and Delivery of Goods.  The Company has no minimum Order value, however, the Company shall charge a fee of £4.95 (ex VAT) for all orders under £20.00.



4. Description and Merchantability of Supplied Goods & Services

4.1. The Company warrants that all goods or services supplied shall match the description applied to it, and shall be of merchantable quality.  

4.2. The Company reserves the right to replace faulty goods with goods of similar quality if it is impossible or impractical to effect repair.

4.3. Under all circumstances of failure, repair or replacement of all goods, the Company will accept no responsibility for any losses; including financial and data information, incurred by the Customer in such circumstances.


5. English Law

5.1. These conditions shall be governed by, and construed in accordance with English Law, and the Courts of England and Wales shall have exclusive jurisdiction to determine any disputes arising between the Company and the Customer.

5.2. These Terms do not affect the Statutory Rights of the Customer.
